General Terms
The All-Ukrainian Charitable Foundation “Chess for Children” (UCF “Chess for Children”) in order to ensure the confidentiality and integrity of Personal Data of individuals, concludes with you (hereinafter “User”) this Confidentiality Agreement (hereinafter “Agreement”) to define the procedure for receiving, storing, processing, using and disclosing the User’s Personal Data when the User uses the Foundation’s Services and the Internet resource https://chessforchildren.org/ (hereinafter the “Site”).
The fact of using the Site and Services means acceptance of the terms of this Agreement. If the Participant does not agree with the terms of this Agreement, he is obliged to refuse to use the Site and the services provided by the Site (hereinafter “Services”).
Terminology
Personal data – information or a set of information about an individual who is identified or can be specifically identified.
Public data – information (including personal data) to which an individual (owner of this data) has provided the access to an unlimited number of people (including by publishing on any website without restricting access to this data) or which in accordance to this Agreement and/or current legislation of Ukraine is not subject to the requirement of confidentiality.
Cookie – a piece of data created by the Site and stored on the User’s computer in the form of one or more files. Cookies do not contain Personal Data and may be blocked by the “User” at any time.
1. Subject of the agreement
1.1. This Agreement specifies the procedure for obtaining, storing, processing, using and disclosing Personal, Publicly Available and other data provided by the User to UCF “Chess for Children” when using the Site and the Services provided by the Site.
1.2. By using any part of the Site, the User grants the UCF “Chess for Children” the right to receive, store, process, use and disclose the User’s Personal Data under the terms of this Agreement.
1.3. This Agreement does not regulate, and UCF “Chess for Children” is not responsible for the procedure for obtaining, storing, processing, using and disclosing the User’s Personal Data by third-party individuals and legal entities that are not owned or operated by UCF “Chess for Children”, and physical persons who are not employees of the UCF “Chess for Children”, even if the User has gained access to the sites, the software of these people through the Site.
1.4. The purpose of obtaining, storing, processing and using the User’s Personal, Public and other data is to protect the rights and interests of the User and the Site, as well as to provide the User with Services, including displaying targeted, personalized or general information, improving the quality of existing and creating new materials and services that provided by the Site.
2. Receipt, processing and use of information
2.1. When registering to receive newsletters from the UCF “Chess for Children”, the User must specify the name, surname, and e-mail address. Specifying personal information by the User when registering for the newsletter is his consent to the collection, processing and use of such information by the “Chess for Children” Foundation.
2.2. UCF “Chess for Children” uses the User’s data for the purpose of supporting and organizing feedback with the User for sending mailings, messages, information, maintaining a contact database, as well as for forming more accurate selections based on the user’s interests.
2.3. UCF “Chess for Children” does not collect any other data about the User, except those that he himself submitted through the forms on the Site.
2.4. UCF “Chess for Children” has the right to download cookie files to the Users’ computers (if the User has not independently limited this possibility in his web browser), as well as to receive, store, process and use the information contained in the Cookies.
2.5. When the User uses the Site and the Services of the equipment on which the Site is located, the Site automatically stores, processes and uses the User’s non-Personal data, for example: the User’s IP address, data about the User’s location, which can be determined using his IP address , technical parameters of the User’s computer, presence or absence of specific software on the User’s computer, settings of this software, cookie files, as well as statistical information about the User’s activity.
2.6. UCF “Chess for Children” has the right to store the User’s Personal, Public and other data in the amount and in the time period necessary for the implementation of the purpose specified in this Agreement, or in the time period established by the current legislation of Ukraine, or until the User deletes this data.
2.7. In the event of changing through Personal Data, the User must provide updated data to the “Chess for Children” Foundation. In case the User does not fulfill this requirement, the Children’s Chess Federation is not responsible for the negative consequences for the User related to the processing of such Personal Data.
3. Access to information
3.1. UCF “Chess for Children” undertakes not to provide Personal data received from Users to third parties for commercial purposes without the consent of the User who provided such data. Transferring of Personal Data to third parties is allowed in the following cases:
- after obtaining the consent of the User to whom this information belongs;
- if it is necessary to transfer Personal Data for the purpose of fulfilling the User’s order or request;
- upon justified requests of the competent authorities that have the right to receive such data;
in the event that the User violates the terms of this Agreement and/or other contracts and agreements between the “Chess for Children” Foundation and the User, when such transfer is due to the protection of the rights and interests of the “Chess for Children” Foundation or other Users.
3.2. The User allows UCF “Chess for Children” to grant permission to other companies with which UCF “Chess for Children” has concluded relevant agreements, to receive, store and process data about the User (except for Personal data), such as the User’s IP address, cookie files, as well as statistical information about the User’s activity for improving the quality of services and advertising information provided by these companies.
3.3. The user agrees that the confidentiality of the data transmitted via the Internet is not guaranteed, and in the event that access to this data is obtained by third parties outside the area of technical means of communication under the authority of UCF “Chess for Children”, UCF “Chess for Children” shall not be liable for damage caused by such access.
3.4. The User has the right to request, change or delete his Personal data, which are accessible by the UCF “Chess for Children”. For this purpose, the User must make a corresponding request by sending it to the contact address of the UCF “Chess for Children” specified on the Site, if another independent way of requesting, changing or deleting Personal Data is not provided for by the technical capabilities of the Site.
4. Additional conditions
4.1. UCF “Chess for Children” has the right to make changes to this Privacy Agreement. All changes to the Agreement will be available as a new version of the Agreement at https://chessforchildren.org/confidential. In the case of making significant changes to the Agreement, the UCF “Chess for Children” will additionally notify the User of these changes by e-mail, which was specified when registering for the newsletter. All changes to the Agreement become effective from the moment of their publication. By using the Services or the Site, the User confirms his agreement with the new terms of the Agreement in the version in effect at the time of the User’s use of the Services and/or the Site.
4.2. UCF “Chess for Children” is not responsible for damage or losses suffered by the User or third parties as a result of misunderstanding or misunderstanding of the terms of this Agreement, instructions or guidelines on the usage of the Site, the placement of data and other technical issues. Before accepting the terms of this Agreement, any User has the right to contact the UCF “Chess for Children” for clarifications regarding the provisions of the Agreement.
4.3. In the event of invalidity of any part of this Agreement, other parts of the Agreement remain valid. The waiver by either party of any provision or condition of this Agreement, or any violation thereof, shall not invalidate this provision or condition.
4.4. The legislation of Ukraine applies to this Agreement and the relations between the UCF “Chess for Children” and the User arising in connection with the use of the Site. Each party expressly agrees that the relevant courts of Ukraine shall have jurisdiction over any claims, disputes or disagreements relating to this Agreement and the use of the Site.
